{"id":498246,"date":"2024-03-03T21:12:13","date_gmt":"2024-03-04T05:12:13","guid":{"rendered":"https:\/\/disabilityvisibilityproject.com\/?p=498246"},"modified":"2026-02-12T17:18:38","modified_gmt":"2026-02-13T01:18:38","slug":"institutionalization-about-us-without-us-californias-proposition-1","status":"publish","type":"post","link":"https:\/\/disabilityvisibilityproject.com\/2024\/03\/03\/institutionalization-about-us-without-us-californias-proposition-1\/","title":{"rendered":"Institutionalization About Us Without Us: California\u2019s Proposition 1\u00a0"},"content":{"rendered":"<h3 class=\"p1\"><b>Institutionalization About Us Without Us: California\u2019s Proposition 1\u00a0<\/b><\/h3>\n<p>&nbsp;<\/p>\n<h4><strong>Katherine Wolf<\/strong><\/h4>\n<p><a href=\"https:\/\/voterguide.sos.ca.gov\/propositions\/1\/\"><span style=\"font-weight: 400;\">Proposition 1<\/span><\/a><span style=\"font-weight: 400;\"> on California\u2019s March 5 primary ballot <\/span><span style=\"font-weight: 400;\">exploits widespread prejudice against people with mental health disabilities to lock up victims of California\u2019s affordable <\/span><a href=\"https:\/\/nlihc.org\/housing-needs-by-state\/california\"><span style=\"font-weight: 400;\">housing<\/span><\/a> <a href=\"https:\/\/www.senate.ca.gov\/media\/senate-joint-hearing-housing-human-services-20230307\/video?time%5bsenate-joint-hearing-housing-human-services-20230307%5d=2611.871473\"><span style=\"font-weight: 400;\">crisis<\/span><\/a><span style=\"font-weight: 400;\"> under the guise of care, while cutting funding from <\/span><a href=\"https:\/\/journals.plos.org\/plosone\/article?id=10.1371\/journal.pone.0271063\"><span style=\"font-weight: 400;\">effective<\/span><\/a><span style=\"font-weight: 400;\">, voluntary, community-based mental health services. Replacing voluntary community services with involuntary institutionalization disregards evidence-based practices in mental health and substance use disorder (SUD) treatment, increases mistrust of medicine, and facilitates discrimination against the most marginalized among us. As a scholar with mental health and physical disabilities conducting research in health equity and disability studies at the University of California, I urge you to reject Proposition 1.<\/span><\/p>\n<p><b><br \/>\n<\/b><span style=\"font-weight: 400;\">California\u2019s affordable housing shortage has left <\/span><a href=\"https:\/\/www.huduser.gov\/portal\/sites\/default\/files\/pdf\/2023-AHAR-Part-1.pdf\"><span style=\"font-weight: 400;\">over 180,000 people<\/span><\/a><span style=\"font-weight: 400;\"> homeless, creating political pressure on Governor Gavin <\/span><a href=\"https:\/\/calmatters.org\/politics\/elections\/2019\/10\/surveys-poll-gavin-newsom-homelessness-housing-ppic\/\"><span style=\"font-weight: 400;\">Newsom<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/www.kqed.org\/news\/11671742\/voters-plea-to-s-f-mayoral-candidates-fix-homelessness\"><span style=\"font-weight: 400;\">city<\/span><\/a> <a href=\"https:\/\/www.latimes.com\/homeless-housing\/story\/2021-12-05\/mayoral-candidates-homelessness-plans\"><span style=\"font-weight: 400;\">mayors<\/span><\/a><span style=\"font-weight: 400;\"> to make encampments disappear. <\/span><span style=\"font-weight: 400;\">Since the 2018 Ninth Circuit decision <\/span><a href=\"https:\/\/cdn.ca9.uscourts.gov\/datastore\/opinions\/2018\/09\/04\/15-35845.pdf\"><span style=\"font-weight: 400;\">Martin v. Boise<\/span><\/a><span style=\"font-weight: 400;\"> imposed moderate constitutional limits on California cities\u2019 ability to arrest unhoused people for existing in public without offering alternate shelter, <\/span><a href=\"https:\/\/www.sfchronicle.com\/politics\/article\/newsom-homeless-rulings-18336300.php\"><span style=\"font-weight: 400;\">Newsom<\/span><\/a><span style=\"font-weight: 400;\"> and mayors have <\/span><a href=\"https:\/\/www.sfchronicle.com\/sf\/article\/s-f-mayor-breed-rejects-allegations-lawsuit-18191036.php\"><span style=\"font-weight: 400;\">sought<\/span><\/a> <a href=\"https:\/\/www.sandiego.gov\/police\/services\/neighborhood-policing-division\/unsafe-camping\"><span style=\"font-weight: 400;\">alternate<\/span><\/a> <a href=\"https:\/\/www.latimes.com\/california\/story\/2023-12-14\/homeless-camp-sweeps-result-in-police-citations-as-often-as-housing-offers-survey-finds\"><span style=\"font-weight: 400;\">ways<\/span><\/a><span style=\"font-weight: 400;\"> to eliminate encampments. Luckily for them, <\/span><span style=\"font-weight: 400;\">involuntary psychiatric holds do not count as arrests under <\/span><i><span style=\"font-weight: 400;\">Martin<\/span><\/i><span style=\"font-weight: 400;\">, and institutional beds count as shelter. Thus, <\/span><span style=\"font-weight: 400;\">with over $14 million in <\/span><a href=\"https:\/\/cal-access.sos.ca.gov\/Campaign\/Measures\/Detail.aspx?id=1463809&amp;session=2023\"><span style=\"font-weight: 400;\">financing<\/span><\/a><span style=\"font-weight: 400;\"> from <\/span><a href=\"https:\/\/cal-access.sos.ca.gov\/Campaign\/Committees\/Detail.aspx?id=1380675&amp;session=2023&amp;view=received&amp;psort=AMOUNT&amp;ssort=AMOUNT\"><span style=\"font-weight: 400;\">rich<\/span><\/a> <a href=\"https:\/\/cal-access.sos.ca.gov\/Campaign\/Committees\/Detail.aspx?id=1465319&amp;session=2023&amp;view=received&amp;psort=AMOUNT\"><span style=\"font-weight: 400;\">special<\/span><\/a> <a href=\"https:\/\/cal-access.sos.ca.gov\/Campaign\/Committees\/Detail.aspx?id=1463883&amp;session=2023&amp;view=received&amp;psort=AMOUNT\"><span style=\"font-weight: 400;\">interests<\/span><\/a><span style=\"font-weight: 400;\">, Newsom and California\u2019s big city mayors are <\/span><a href=\"https:\/\/www.gov.ca.gov\/2023\/10\/12\/governor-newsom-puts-historic-mental-health-transformation-on-march-2024-ballot\/\"><span style=\"font-weight: 400;\">promoting<\/span><\/a><span style=\"font-weight: 400;\"> Proposition 1 not to improve mental health care for Californians, but to <\/span><a href=\"https:\/\/www.law360.com\/articles\/1526664\"><span style=\"font-weight: 400;\">remove<\/span><\/a><span style=\"font-weight: 400;\"> people without housing from sight (<\/span><a href=\"https:\/\/www.youtube.com\/watch?v=9uRmsqO7Iz4\"><span style=\"font-weight: 400;\">\u201cTreatment Not Tents\u201d<\/span><\/a><span style=\"font-weight: 400;\">).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Proposition 1 follows a <\/span><a href=\"https:\/\/disabilityvisibilityproject.com\/2023\/10\/15\/return-of-the-ugly-laws-in-the-name-of-modernization-the-newsom-administration-wants-to-disappear-unhoused-and-disabled-people-from-the-streets-rebuild-the-asylums\/\"><span style=\"font-weight: 400;\">series<\/span><\/a><span style=\"font-weight: 400;\"> of Newsom-endorsed bills since 2019 that erode the civil rights of persons with mental health disabilities and widen the path to institutionalization. They weaken patient <\/span><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202320240SB35\"><span style=\"font-weight: 400;\">privacy<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202320240SB43\"><span style=\"font-weight: 400;\">hearsay<\/span><\/a><span style=\"font-weight: 400;\"> protections, <\/span><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202120220SB1338\"><span style=\"font-weight: 400;\">create<\/span><\/a><span style=\"font-weight: 400;\"> a new <\/span><a href=\"https:\/\/www.dhcs.ca.gov\/Pages\/CARE-ACT.aspx\"><span style=\"font-weight: 400;\">system<\/span><\/a><span style=\"font-weight: 400;\"> of mental health (\u201cCARE\u201d) <\/span><a href=\"https:\/\/www.courts.ca.gov\/documents\/10-Things-to-Know-About-the-CARE-Act.pdf\"><span style=\"font-weight: 400;\">courts<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202320240SB43\"><span style=\"font-weight: 400;\">drastically<\/span><\/a> <a href=\"https:\/\/www.disabilityrightsca.org\/latest-news\/sb-43-eggman-expanding-the-definition-of-gravely-disabled\"><span style=\"font-weight: 400;\">expand<\/span><\/a><span style=\"font-weight: 400;\"> criteria for involuntary psychiatric holds and forced treatment, <\/span><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202320240SB402\"><span style=\"font-weight: 400;\">allow<\/span><\/a><span style=\"font-weight: 400;\"> private <\/span><a href=\"https:\/\/calmatters.org\/health\/mental-health\/2024\/01\/california-5150-therapists\/\"><span style=\"font-weight: 400;\">therapists<\/span><\/a><span style=\"font-weight: 400;\"> to initiate those holds, and <\/span><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billAnalysisClient.xhtml?bill_id=202120220AB133\"><span style=\"font-weight: 400;\">spend<\/span><\/a> <a href=\"https:\/\/www.infrastructure.buildingcalhhs.com\/\"><span style=\"font-weight: 400;\">billions<\/span><\/a><span style=\"font-weight: 400;\"> to create <\/span><a href=\"https:\/\/www.infrastructure.buildingcalhhs.com\/wp-content\/uploads\/2023\/12\/BHCIP-Infographics_508_Dec_14.pdf\"><span style=\"font-weight: 400;\">several thousand<\/span><\/a><span style=\"font-weight: 400;\"> new institutional beds. Proposition 1, approved by the legislature in 2023 pending the popular vote, continues this trend.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202320240AB531\"><span style=\"font-weight: 400;\">first part<\/span><\/a><span style=\"font-weight: 400;\"> of <\/span><a href=\"https:\/\/lao.ca.gov\/BallotAnalysis\/Proposition?number=1&amp;year=2024\"><span style=\"font-weight: 400;\">Proposition 1<\/span><\/a><span style=\"font-weight: 400;\"> issues a $6.4 billion bond for buildings, not services. While less than one third of it promises 4,350 units of permanent supportive housing, the remaining more than two thirds, $4.4 billion, funds 6,800 new beds in treatment facilities. These institutional beds, which are not long-term housing, will cost California taxpayers over $646,000 each before bond interest. Worse, after the bond\u2019s <\/span><a href=\"https:\/\/www.senate.ca.gov\/media\/senate-housing-committee-20230710?time%5bsenate-housing-committee-20230710%5d=6227.72711\"><span style=\"font-weight: 400;\">author<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.senate.ca.gov\/media\/senate-housing-committee-20230710?time%5bsenate-housing-committee-20230710%5d=6441.393439\"><span style=\"font-weight: 400;\">proponents<\/span><\/a><span style=\"font-weight: 400;\">, and original <\/span><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billVersionsCompareClient.xhtml?bill_id=202320240AB531&amp;cversion=20230AB53198AMD\"><span style=\"font-weight: 400;\">language<\/span><\/a><span style=\"font-weight: 400;\"> promised <\/span><a href=\"https:\/\/www.senate.ca.gov\/media\/senate-governance-finance-committee-20230712\/video?time%5bsenate-governance-finance-committee-20230712%5d=15532.927551\"><span style=\"font-weight: 400;\">for<\/span><\/a> <a href=\"https:\/\/www.senate.ca.gov\/media\/senate-governance-finance-committee-20230712\/video?time%5bsenate-governance-finance-committee-20230712%5d=15799.636678\"><span style=\"font-weight: 400;\">months<\/span><\/a><span style=\"font-weight: 400;\"> that all the beds would be community-based, unlocked, and only for voluntary treatment, the authors <\/span><a href=\"https:\/\/drive.google.com\/file\/d\/1eLgYkvi9gYOEWJZUZrcx3bAEm_tptepN\/view?usp=sharing\"><span style=\"font-weight: 400;\">betrayed<\/span><\/a><span style=\"font-weight: 400;\"> disabled <\/span><a href=\"https:\/\/drive.google.com\/file\/d\/1CAW-uwWXWk_2efqi-ow7WFAWmId_Wg2a\/view?usp=sharing\"><span style=\"font-weight: 400;\">advocates<\/span><\/a><span style=\"font-weight: 400;\"> by <\/span><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billVersionsCompareClient.xhtml?bill_id=202320240AB531&amp;cversion=20230AB53197AMD\"><span style=\"font-weight: 400;\">amending<\/span><\/a><span style=\"font-weight: 400;\"> the bill <\/span><a href=\"https:\/\/www.assembly.ca.gov\/media\/assembly-housing-and-community-development-20230914?time%5bmedia-element-3134%5d=3378.92964\"><span style=\"font-weight: 400;\">less than 81 hours<\/span><\/a><span style=\"font-weight: 400;\"> before passage to replace every instance of \u201cvoluntary\u201d and \u201cunlocked\u201d with language allowing forced treatment.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202320240SB326\"><span style=\"font-weight: 400;\">second part<\/span><\/a><span style=\"font-weight: 400;\"> of Proposition 1 restructures the <\/span><a href=\"https:\/\/www.dhcs.ca.gov\/services\/MH\/Pages\/MH_Prop63.aspx\"><span style=\"font-weight: 400;\">Mental Health Services Act<\/span><\/a><span style=\"font-weight: 400;\"> (MHSA) into the Behavioral Health Services Act (BHSA). MHSA was <\/span><a href=\"https:\/\/cpehn.org\/publications\/a-right-to-heal-mental-health-in-diverse-communities\/\"><span style=\"font-weight: 400;\">designed<\/span><\/a><span style=\"font-weight: 400;\"> by disabled people <\/span><a href=\"https:\/\/www.calvoices.org\/copy-of-access-advocacy-resources\"><span style=\"font-weight: 400;\">themselves<\/span><\/a><span style=\"font-weight: 400;\"> to fund voluntary, community-based treatment programs through a tax on incomes over $1 million that generates <\/span><a href=\"https:\/\/www.dhcs.ca.gov\/services\/MH\/Pages\/MHSA-Fiscal-Oversight.aspx\"><span style=\"font-weight: 400;\">over $3 billion<\/span><\/a><span style=\"font-weight: 400;\"> per year. BHSA, designed <\/span><a href=\"https:\/\/www.assembly.ca.gov\/media\/assembly-health-committee-20230822?time%5bmedia-element-3085%5d=3425.06755\"><span style=\"font-weight: 400;\">without<\/span><\/a> <a href=\"https:\/\/www.assembly.ca.gov\/media\/assembly-health-committee-20230822?time%5bmedia-element-3085%5d=2572.20959\"><span style=\"font-weight: 400;\">disabled<\/span><\/a> <a href=\"https:\/\/www.assembly.ca.gov\/media\/assembly-housing-and-community-development-committee-20230828?time%5bmedia-element-3093%5d=3483.115883\"><span style=\"font-weight: 400;\">people<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/lao.ca.gov\/Publications\/Report\/4782\"><span style=\"font-weight: 400;\">redirects<\/span><\/a><span style=\"font-weight: 400;\"> much of that money to cover stand-alone SUD treatment and a new housing mandate. Counties <\/span><a href=\"https:\/\/www.assembly.ca.gov\/media\/joint-hearing-health-and-housing-and-community-development-20230822?time%5bmedia-element-3082%5d=19448.98509\"><span style=\"font-weight: 400;\">testified<\/span><\/a><span style=\"font-weight: 400;\"> that they must <\/span><a href=\"https:\/\/www.counties.org\/sites\/main\/files\/file-attachments\/sb_326_amended_8-23_county_coalition_letter_-_asm_appropriations.pdf\"><span style=\"font-weight: 400;\">cut<\/span><\/a> <a href=\"https:\/\/lao.ca.gov\/BallotAnalysis\/Proposition?number=1&amp;year=2024\"><span style=\"font-weight: 400;\">existing<\/span><\/a><span style=\"font-weight: 400;\"> mental health <\/span><a href=\"https:\/\/www.assembly.ca.gov\/media\/joint-hearing-health-and-housing-and-community-development-20230822?time%5bmedia-element-3082%5d=21736.159741\"><span style=\"font-weight: 400;\">services<\/span><\/a><span style=\"font-weight: 400;\"> to compensate. Losing MHSA-funded services risks the mental health of Californians using them and will likely cause some to lose their homes.<\/span><\/p>\n<p><a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/36128697\/\"><span style=\"font-weight: 400;\">Evidence<\/span><\/a> <a href=\"https:\/\/www.who.int\/publications\/i\/item\/guidance-and-technical-packages-on-community-mental-health-services\"><span style=\"font-weight: 400;\">supports<\/span><\/a><span style=\"font-weight: 400;\"> such <\/span><a href=\"https:\/\/www.senate.ca.gov\/media\/senate-joint-hearing-housing-human-services-20230307\/video?time%5bsenate-joint-hearing-housing-human-services-20230307%5d=1984.505814\"><span style=\"font-weight: 400;\">voluntary<\/span><\/a><span style=\"font-weight: 400;\">, community-based services over the involuntary hospitalizations that Proposition 1 funds. <\/span><a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/28564699\/\"><span style=\"font-weight: 400;\">Suicide<\/span><\/a> <a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/30904843\/\"><span style=\"font-weight: 400;\">rates<\/span><\/a> <a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/38353967\/\"><span style=\"font-weight: 400;\">skyrocket<\/span><\/a><span style=\"font-weight: 400;\"> after psychiatric hospitalizations, and coercion <\/span><a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/31162700\/\"><span style=\"font-weight: 400;\">increases<\/span><\/a><span style=\"font-weight: 400;\"> the risk. Involuntary hospitalization <\/span><a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/33989262\/\"><span style=\"font-weight: 400;\">particularly<\/span><\/a> <a href=\"https:\/\/journals.lww.com\/cja\/fulltext\/2023\/12000\/effectiveness_of_involuntary_treatment_for.2.aspx\"><span style=\"font-weight: 400;\">backfires<\/span><\/a><span style=\"font-weight: 400;\"> for <\/span><a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/36995493\/\"><span style=\"font-weight: 400;\">SUDs<\/span><\/a><span style=\"font-weight: 400;\">. Mere fear of involuntary hospitalization leads people to <\/span><a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/33734741\/\"><span style=\"font-weight: 400;\">hide<\/span><\/a> <a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/33751175\/\"><span style=\"font-weight: 400;\">distress<\/span><\/a><span style=\"font-weight: 400;\"> from clinicians or <\/span><a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC8441267\/\"><span style=\"font-weight: 400;\">avoid<\/span><\/a> <a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/36218823\/\"><span style=\"font-weight: 400;\">treatment<\/span><\/a><span style=\"font-weight: 400;\"> entirely. Those of us with mental health disabilities deserve to seek care and develop honest, trusting relationships with clinicians without fear of force.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Proposition 1 also flouts international and national standards for the civil rights of people with mental health disabilities. <\/span><a href=\"https:\/\/www.who.int\/publications\/i\/item\/9789240025707\"><span style=\"font-weight: 400;\">World Health Organization<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/www.who.int\/publications\/i\/item\/9789240080737\"><span style=\"font-weight: 400;\">United Nations<\/span><\/a><span style=\"font-weight: 400;\"> guidance and several <\/span><a href=\"https:\/\/www.ohchr.org\/en\/instruments-mechanisms\/instruments\/convention-rights-persons-disabilities\"><span style=\"font-weight: 400;\">international treaties<\/span><\/a><span style=\"font-weight: 400;\"> prohibit <\/span><a href=\"https:\/\/www.ohchr.org\/en\/special-procedures\/wg-arbitrary-detention\/international-standards\"><span style=\"font-weight: 400;\">involuntary institutionalization<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/undocs.org\/A\/HRC\/43\/49\"><span style=\"font-weight: 400;\">forced treatment<\/span><\/a><span style=\"font-weight: 400;\">. Proposition 1 drags California even further <\/span><a href=\"https:\/\/digitallibrary.un.org\/record\/1655103?ln=en\"><span style=\"font-weight: 400;\">out of compliance<\/span><\/a><span style=\"font-weight: 400;\">. It also violates <\/span><a href=\"https:\/\/archive.ada.gov\/olmstead\/olmstead_about.htm\"><span style=\"font-weight: 400;\">federal constitutional standards<\/span><\/a><span style=\"font-weight: 400;\"> that require treatment in the least restrictive setting possible, which California counties <\/span><a href=\"https:\/\/www.disabilityrightsca.org\/cases\/disability-rights-california-lawsuit-against-alameda-county\"><span style=\"font-weight: 400;\">already<\/span><\/a> <a href=\"https:\/\/www.disabilityrightsca.org\/what-we-do\/cases\/new-cases-and-amicus-briefs\"><span style=\"font-weight: 400;\">ignore<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Proposition 1\u2019s legislative authors exposed their discriminatory intent during the hearings. They called no unhoused witnesses and none who disclosed a mental health disability. They ignored the recommendations of <\/span><a href=\"https:\/\/www.assembly.ca.gov\/media\/joint-hearing-health-and-housing-and-community-development-20230822?time%5bmedia-element-3082%5d=21198.472306\"><span style=\"font-weight: 400;\">opposing<\/span><\/a> <a href=\"https:\/\/www.assembly.ca.gov\/media\/assembly-health-committee-20230822?time%5bmedia-element-3085%5d=1576.460586\"><span style=\"font-weight: 400;\">witnesses<\/span><\/a><span style=\"font-weight: 400;\"> who did. In hearings for both Proposition 1 and the companion bill expanding forced treatment criteria, Proposition 1\u2019s proponents deployed racist and sanist stereotypes, portraying Black and brown people as <\/span><a href=\"https:\/\/www.senate.ca.gov\/media\/senate-health-committee-20230329\/video?time%5bsenate-health-committee-20230329%5d=5450.861717\"><span style=\"font-weight: 400;\">criminal<\/span><\/a><span style=\"font-weight: 400;\"> and people with mental health disabilities as <\/span><a href=\"https:\/\/www.senate.ca.gov\/media\/senate-health-committee-20230329\/video?time%5bsenate-health-committee-20230329%5d=3497.821829\"><span style=\"font-weight: 400;\">dirty<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.senate.ca.gov\/media\/senate-judiciary-committee-20230425\/video?time%5bsenate-judiciary-committee-20230425%5d=14523.490183\"><span style=\"font-weight: 400;\">unaware<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.senate.ca.gov\/media\/senate-floor-session-20230914\/video?time%5bsenate-floor-session-20230914%5d=10489.822885\"><span style=\"font-weight: 400;\">violent<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.senate.ca.gov\/media\/senate-floor-session-20230914\/video?time%5bsenate-floor-session-20230914%5d=9099.082064\"><span style=\"font-weight: 400;\">incapable<\/span><\/a><span style=\"font-weight: 400;\"> of recovery, and <\/span><a href=\"https:\/\/www.senate.ca.gov\/media\/senate-health-committee-20230329\/video?time%5bsenate-health-committee-20230329%5d=5400.606839\"><span style=\"font-weight: 400;\">likely<\/span><\/a><span style=\"font-weight: 400;\"> to <\/span><a href=\"https:\/\/www.senate.ca.gov\/media\/senate-floor-session-20230914\/video?time%5bsenate-floor-session-20230914%5d=9099.082064\"><span style=\"font-weight: 400;\">die<\/span><\/a><span style=\"font-weight: 400;\">. One even <\/span><a href=\"https:\/\/www.assembly.ca.gov\/media\/assembly-health-committee-20230627?time%5bmedia-element-2999%5d=13059.487734\"><span style=\"font-weight: 400;\">mocked<\/span><\/a><span style=\"font-weight: 400;\"> people who hear voices.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Their prejudice is not without consequence. Proposition 1 would disproportionately impose forced treatment on already marginalized Californians. For example, systemic racism <\/span><a href=\"https:\/\/ternercenter.berkeley.edu\/wp-content\/uploads\/2023\/10\/Five-Trends-in-CA-Homelessness_Oct-2023-5.pdf\"><span style=\"font-weight: 400;\">leaves<\/span><\/a><span style=\"font-weight: 400;\"> Black and Indigenous Californians <\/span><a href=\"https:\/\/homelessness.ucsf.edu\/sites\/default\/files\/2023-06\/CASPEH_Report_62023.pdf\"><span style=\"font-weight: 400;\">unhoused<\/span><\/a><span style=\"font-weight: 400;\"> at enormous rates compared to white Californians and thus more likely targets of forced interventions under Proposition 1. Physicians (<\/span><a href=\"https:\/\/hcai.ca.gov\/visualizations\/race-ethnicity-of-californias-health-workforce\/\"><span style=\"font-weight: 400;\">overwhelmingly<\/span><\/a> <a href=\"https:\/\/www.cbhda.org\/s\/CBHDA_Needs_Assessment_FINAL_Report_2-23.pdf\"><span style=\"font-weight: 400;\">white and Asian<\/span><\/a><span style=\"font-weight: 400;\"> in California) also <\/span><a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/36846217\/\"><span style=\"font-weight: 400;\">notoriously<\/span><\/a> <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC4274585\/\"><span style=\"font-weight: 400;\">overdiagnose<\/span><\/a> <a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/29094963\/\"><span style=\"font-weight: 400;\">Black<\/span><\/a><span style=\"font-weight: 400;\"> patients with schizophrenia spectrum and psychotic disorders and <\/span><a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/35959533\/\"><span style=\"font-weight: 400;\">disproportionately<\/span><\/a> <a href=\"https:\/\/www.disabilityrightsca.org\/latest-news\/drc-and-coalition-opposition-letter-to-sb-43-assembly-health-committee#footnoteref25_d6d4x1q\"><span style=\"font-weight: 400;\">subject<\/span><\/a><span style=\"font-weight: 400;\"> patients of color to involuntary psychiatric holds.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Unhoused and disabled people deserve <\/span><a href=\"https:\/\/homelessness.ucsf.edu\/sites\/default\/files\/2023-06\/CASPEH_Executive_Summary_62023.pdf\"><span style=\"font-weight: 400;\">evidence-based<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/housingequityframework.org\/\"><span style=\"font-weight: 400;\">racially equitable<\/span><\/a><span style=\"font-weight: 400;\">, and cost-effective policies, designed by and with us, that actually keep people housed. <\/span><a href=\"https:\/\/homelessness.ucsf.edu\/sites\/default\/files\/2023-06\/CASPEH_Executive_Summary_62023.pdf\"><span style=\"font-weight: 400;\">Examples<\/span><\/a><span style=\"font-weight: 400;\"> include direct cash <\/span><a href=\"https:\/\/www.pnas.org\/doi\/10.1073\/pnas.2222103120\"><span style=\"font-weight: 400;\">payments<\/span><\/a><span style=\"font-weight: 400;\">; rental assistance; affordable permanent housing; and mental health and SUD services that are <\/span><a href=\"https:\/\/www.senate.ca.gov\/media\/senate-joint-hearing-housing-human-services-20230307\/video?time%5bsenate-joint-hearing-housing-human-services-20230307%5d=1984.505814\"><span style=\"font-weight: 400;\">voluntary<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.samhsa.gov\/brss-tacs\/recovery-support-tools\/peers\"><span style=\"font-weight: 400;\">peer-directed<\/span><\/a><span style=\"font-weight: 400;\">, community-based, easily <\/span><a href=\"https:\/\/www.senate.ca.gov\/media\/senate-joint-hearing-housing-human-services-20230307\/video?time%5bsenate-joint-hearing-housing-human-services-20230307%5d=2024.528479\"><span style=\"font-weight: 400;\">available<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.cpehn.org\/what-we-do-2\/our-networks\/behavioral-health-equity-collaborative\/\"><span style=\"font-weight: 400;\">culturally<\/span><\/a> <a href=\"https:\/\/cultureishealth.org\/our-mission\/\"><span style=\"font-weight: 400;\">responsive<\/span><\/a><span style=\"font-weight: 400;\">, and abundantly funded. Not forced institutionalization.
